These Terms of Service apply to the use of this website and to the supply of goods and services by Active Golf Projects Ltd ("we", "us", "our").

2. Definitions

Agreement means these Terms together with any quotation, order confirmation, or specification document.

Customer means any individual or organisation purchasing goods or services from us.

Goods means any physical products supplied by us, including bespoke or cut-to-size items.

Services means any design, installation, consultancy, or related services.

Specification Document means any quotation, statement of work, or order confirmation issued by us.
3. Website use and registration
3.1 You agree to use the website only for lawful purposes.
3.2 Where account registration is required, you confirm that all information provided is accurate and kept up to date.
3.3 You must not impersonate any other person or misuse the website.
4. Product descriptions and specifications
4.1 All descriptions, images, and specifications are provided for guidance only.
4.2 Images are illustrative and may not represent the exact appearance of the product supplied.
4.3 Colours, finishes, and textures may vary due to screen settings, materials, and manufacturing processes.
4.4 Bespoke, made-to-order, or cut-to-size goods are produced strictly in accordance with the specification confirmed at order stage and cannot be altered once production has commenced.
5. Orders and acceptance
5.1 Orders placed via the website are subject to acceptance by us.
5.2 We reserve the right to refuse or cancel any order prior to dispatch without liability.
5.3 If an order confirmation contains any errors, you must notify us immediately. Due to rapid processing and dispatch, amendments may not always be possible once a tracking notification has been issued.
6. Price and payment
6.1 Prices are shown in pounds sterling unless otherwise stated.
6.2 Payment must be made in accordance with the terms shown at checkout or in the Specification Document.
6.3 We may charge interest on overdue invoices at 2 percent per annum above the Bank of England base rate.
6.4 Payments made online are processed securely by third-party payment providers.
7. Delivery times and delivery delays
7.1 Delivery times are estimates only and time is not of the essence.
7.2 Standard delivery is typically 2 to 3 working days between 8am and 8pm, unless otherwise stated.
7.3 Next working day delivery may be available on orders placed before the stated cut-off time, but this is not guaranteed.
7.4 We are not liable for delays caused by third-party carriers, incorrect delivery information supplied by the Customer, or events beyond our reasonable control.
7.5 Any delivery upgrade charges paid will be refunded if the carrier fails to meet the upgraded service level. This shall be the limit of any claim.
8. Delivery method and access
8.1 Deliveries are carried out by third-party carriers and are kerb-side only.
8.2 Deliveries are typically a one-person service and assistance must be available for unloading.
8.3 The Customer must inform us in advance of any access restrictions, including but not limited to narrow roads, low trees, steps, or restricted access.
8.4 Drivers are allocated a limited time, typically 15 minutes, to unload and obtain a signature.
8.5 We are not liable for failed, refused, or delayed deliveries due to access issues or inability to unload within the allotted time.
9. Failed deliveries
9.1 If delivery fails for any reason, goods may be held at the carrier’s depot for a limited period before being returned to us.
9.2 Re-delivery, return, or cancellation charges may apply.
9.3 If goods are left with a neighbour or third party at the Customer’s request, we accept no responsibility for loss or misplacement.
10. Inspection, damages, and acceptance
10.1 Goods must be inspected immediately upon delivery and before installation, cutting, or use.
10.2 Any visible damage must be recorded on the delivery note and reported to us within 24 hours.
10.3 If goods are signed for as received in good condition, claims for transit damage may not be accepted.
10.4 Goods must not be installed, cut, or used until fully inspected and confirmed as correct.
11. Acceptance of cut-to-size and bespoke materials
11.1 We reserve the right to oversupply cut lengths by up to 1.5 metres and to supply within industry tolerances, including BS 3655 roll material tolerances of +/- 1.25 percent.
11.2 The Customer is responsible for ensuring sufficient quantities are ordered, taking tolerances into account.
11.3 Once goods have been cut, installed, or altered in any way, they are deemed accepted and owned by the Customer.
IMPORTANT:
Once you or your installer cut or install the material, it is accepted and owned by you. No claims will be accepted thereafter.
12. Errors in supply
12.1 Claims for errors in size, type, or specification must be supported by photographic evidence.
12.2 Where an error is confirmed, we will replace the affected goods or issue a refund at our discretion.
12.3 We reserve the right to collect the original goods before dispatching replacements.
12.4 Failure to make goods available for collection may result in the goods being treated as an outstanding debt at full retail value.
13. Cancellations and bespoke cutting fees
13.1 Orders may be cancelled for a full refund prior to cutting or dispatch.
13.2 Once cutting has commenced, a minimum cutting fee of £25 or 25 percent of the order value excluding delivery, whichever is greater, will apply.
13.3 Boxed or retail packaged items are not subject to cutting fees.
13.4 Refused deliveries may result in outbound and return delivery charges being deducted from any refund.
14. Returns and refunds
14.1 Consumer rights under the Consumer Rights Act 2015 remain unaffected.
14.2 Standard stock goods may be returned in accordance with our Returns Policy.
14.3 Bespoke or cut-to-size goods are non-refundable unless faulty.
14.4 Returned goods must be unused, uncut, and in original packaging.
15. Services
15.1 Services will be performed with reasonable skill and care in line with industry standards.
15.2 Delays caused by Customer actions or third parties may result in revised schedules or additional costs.
16. Limitation of liability
16.1 Nothing in these Terms limits liability for death or personal injury caused by negligence.
16.2 Our total liability shall not exceed the amount paid for the goods or services giving rise to the claim.
16.3 We are not liable for indirect, consequential, or economic losses, including loss of profits, business interruption, or wasted costs such as installer bookings or events.
17. Intellectual property
All intellectual property rights in content, designs, materials, and services remain our property unless otherwise agreed in writing.
18. Force majeure
We shall not be liable for failure or delay caused by events beyond our reasonable control.
19. Governing law
These Terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
